Final Medicare E-Prescribing Rule May Come Soon

The Centers for Medicare and Medicaid Services soon expects to publish a final rule making changes to Medicare's Electronic Prescribing Incentive Program.

CMS has sent the rule for review to the Office of Management and Budget, one of the last steps before publication in the Federal Register.

In a proposed rule published on June 1, CMS said the changes are designed to better align the eRX Incentive program with the electronic health record meaningful use incentive program. The program does not require certification of the system.

Under the proposed rule, EHRs that have received meaningful use certification would be deemed to qualify for the eRX Incentive program by expanding the definition of a qualified e-prescribing system. The proposed rule also called for additional opportunities to providers to get a "hardship exemption."

The HHS Friday also awarded 13 states and the District of Columbia $185 million in grants to help them build the exchanges. Last year, HHS gave $50 million in planning grants to nearly all states and $241 million in "early innovator" grants to help seven states establish exchanges that other local governments could use as a model.

States are facing a deadline of Jan. 1, 2013, to submit detailed plans for how their exchanges will work, or the HHS would come in and do the work to ensure the exchanges are operational by 2014.

Why Do Court Reporters Interrupt People When They Are Talking?

During a legal deposition or court proceeding, court reporters sometimes interrupt the witness or the attorneys when they are speaking. While some people may think they are being rude or annoying, the truth is, they are simply doing their job. A court reporter, also sometimes called a court stenographer, is present to make a record of what everyone is saying. They are a neutral third party that is not involved in the case. They are paid to take down an accurate verbatim account of the proceedings that can be "written up" later and turned into a certified booklet of all questions, answers and dialogue. When they cannot make a clear record on their stenotype machine for any reason, they will stop the proceedings or briefly interrupt in an effort to fix the problem.

Witnesses sometimes do not really want to talk about things, especially things that cause them to be in a lawsuit. As most people do when they say something that they don't really want other people to hear, they mumble. When witnesses mumble and the court reporter cannot understand what they are saying, the stenographer will interrupt. When people are arguing, they not only speak faster, but will run over each other's words as well. This make for extra difficulty in creating a reliable transcription of the proceedings.
